Please read these Terms of Service ("Terms") carefully before using اذکار (the "App").

Agreement to Terms

By accessing or using اذکار, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

You represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Intellectual Property Rights

The App and its original content, features, and functionality are owned by Zakaria Fatahi and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the App or any part thereof without our prior written consent.

Prohibited Activities

You agree that you shall not:

  • Use the App for any illegal or unauthorized purpose
  • Harass, abuse, threaten, or intimidate other users
  • Upload or transmit viruses, malware, or other harmful code
  • Reverse engineer, decompile, or disassemble the App
  • Interfere with or disrupt the integrity or performance of the App
  • Attempt to gain unauthorized access to the App or its systems

Termination

We may terminate or suspend your access to اذکار immediately, without prior notice or liability, for any reason, including breach of these Terms.

You may stop using the App at any time by uninstalling it from your device.

Upon termination:

  • Your right to use the App will cease immediately
  • Any locally stored data may be removed when you uninstall the App
  • All provisions that should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The App will be uninterrupted, timely, secure, or error-free
  • The results obtained from the App will be accurate or reliable
  • Any errors in the App will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved exclusively in the courts of Germany.

Before initiating formal proceedings, the parties agree to attempt to resolve disputes informally for at least thirty (30) days.

Apple App Store Terms

If you access اذکار through the Apple App Store, the following additional terms apply and form the Apple-required licensed-application end user license agreement (EULA) addendum:

  • These Terms are between you and Zakaria Fatahi, not with Apple Inc. ("Apple"). Zakaria Fatahi alone is responsible for the App and its content.
  • The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions (except that the App may be accessed, acquired, and used by other accounts associated with the purchaser via Family Sharing or volume purchasing)
  • Apple has no obligation to provide any maintenance or support services with respect to the App. If any maintenance or support is required, Zakaria Fatahi — not Apple — will be solely responsible
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App
  • Zakaria Fatahi — not Apple — is responsible for addressing any user or third-party claims relating to the App or your possession and use of it, including: product-liability claims; any claim that the App fails to conform to any applicable legal or regulatory requirement; claims arising under consumer-protection, privacy, or similar legislation
  • In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Zakaria Fatahi — not Apple — will be solely responsible for the investigation, defense, settlement, and discharge of that claim
  • You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties
  • You must comply with any applicable third-party terms of agreement when using the App (for example, your wireless data service agreement)
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary

Google Play Terms

If you access اذکار through Google Play, you also agree to the Google Play Terms of Service. In the event of a conflict between these Terms and the Google Play Terms, the Google Play Terms shall prevail with respect to your use of Google Play.

Internet Connection & Data Charges

The App can function without an internet connection.

You are responsible for any data charges incurred through your mobile carrier or internet service provider when using the App. We are not responsible for any charges applied by your service provider.

Modifications

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least thirty (30) days' notice prior to any new terms taking effect.

By continuing to access or use اذکار after those revisions become effective, you agree to be bound by the revised Terms.

General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and us regarding the App
  • Severability: If any provision is found to be unenforceable, the remaining provisions will remain in effect
  • Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision
  • Assignment: You may not assign these Terms without our prior written consent. We may assign our rights and obligations freely
  • Electronic Communications: You consent to receive communications from us electronically
